These Terms & Conditions apply to retreats organised by Escapes with Julia (“the Organiser”, “we”, “us” or “our”).
By booking a retreat with us, you confirm that you have read, understood and agree to these Terms & Conditions.
1. Booking & Acceptance of Terms
A place on a retreat is only confirmed once the required booking deposit has been received by the Organiser.
Submitting an enquiry, expressing an intention to attend, or receiving provisional confirmation does not secure a place without payment of the deposit.
By paying the deposit, the participant confirms that they have read, understood and accepted these Terms & Conditions and enters into a booking agreement with the Organiser.
The deposit is non-refundable where the participant chooses to cancel, except where a refund is required by applicable law or these Terms & Conditions.
Places are subject to availability.
2. Payment
The deposit amount will be clearly stated at the time of booking.
The remaining balance must be paid no later than four (4) weeks before the retreat check-in date, unless a different payment schedule has been agreed in writing.
If the balance is not received by the due date, we reserve the right to treat the booking as cancelled and offer the place to another participant, subject to applicable consumer law.
For bookings made within four weeks of the retreat, the full retreat price may be payable at the time of booking.
Participants are responsible for ensuring payments are made by the stated deadlines.
3. Participant Cancellation
If you need to cancel your place, you must notify the Organiser in writing as soon as possible.
Any refund of payments beyond the deposit will depend on the date of cancellation, costs already incurred or committed by the Organiser, our ability to reallocate the place and any rights you have under applicable law.
Where applicable, reasonable cancellation charges may be deducted from sums paid to reflect losses incurred as a result of the cancellation.
We strongly recommend that participants purchase appropriate travel insurance at the time of booking which includes cancellation cover.
Nothing in these Terms & Conditions limits any statutory right to cancel without a termination fee where such a right applies.
4. Cancellation by the Organiser
Our retreats normally require a minimum of five paying participants to proceed.
The Organiser reserves the right to cancel a retreat if the minimum number of participants is not reached, provided any cancellation is made within the notice periods required by applicable law.
If we cancel a retreat because the minimum number has not been reached, participants will receive a refund of payments made to the Organiser in accordance with applicable law.
The Organiser may also cancel a retreat where unavoidable or extraordinary circumstances make it impossible or unsafe to operate the retreat.
The Organiser is not responsible for consequential expenses incurred by participants, such as independently booked flights, airport parking or other arrangements, except where liability cannot legally be excluded.
Participants should therefore ensure their travel insurance provides appropriate cancellation and disruption cover.
5. Changes to the Retreat
Retreat itineraries are intended as a guide.
The Organiser may make reasonable changes to activities, instructors, venues, timings, meals, excursions or the order of the programme where necessary because of weather, safety considerations, availability, local conditions or circumstances outside our reasonable control.
Where a significant change affects the retreat, participants will be informed as soon as reasonably possible and any rights available under applicable law will apply.
Activities may also be changed or cancelled where the Organiser or activity provider reasonably considers conditions unsafe.
6. Check-in & Check-out
Unless otherwise stated for a particular retreat:
Check-in is from 4:00 pm.
Check-out is by 12:00 noon.
Different arrangements may apply to individual retreats and will be communicated by the Organiser before arrival.
Early arrival or late departure cannot be guaranteed.
7. Travel Arrangements
Unless specifically stated as included in the retreat package, participants are responsible for arranging and paying for their own:
- flights and other travel to and from the destination;
- airport transfers;
- visas and entry requirements;
- passports and travel documents;
- travel insurance; and
- personal expenses.
Participants are responsible for ensuring they arrive at the retreat location at the appropriate time.
The Organiser cannot be responsible for missed flights, flight cancellations, delays or other independently arranged transport, except where responsibility arises under applicable law.
8. Travel Insurance
All participants are required to have adequate travel insurance for the entire duration of the retreat.
Insurance should be appropriate for the destination and activities undertaken and should, where reasonably available, include cover for medical treatment, emergency assistance, cancellation, curtailment, personal belongings and the activities included in the retreat.
Participants are responsible for checking that their chosen policy provides suitable cover.
The Organiser may request confirmation that appropriate insurance is in place.
9. Health, Fitness & Participation
Our retreats may include physical activities such as strength and conditioning training, walking, hiking, swimming, fitness sessions and other recreational or wellness activities.
By booking, participants confirm that they are sufficiently fit and medically able to participate in the activities they choose to undertake.
Participants are responsible for informing the Organiser before the retreat of any medical condition, injury, pregnancy, allergy, medication, disability or other circumstance that may reasonably affect their safe participation or require consideration when planning activities.
Where there is any uncertainty regarding suitability to participate, participants should seek appropriate medical advice before attending.
Participation in individual activities is voluntary. Participants should work within their own abilities and stop an activity if they feel unwell, experience pain or believe continuing would be unsafe.
The Organiser or activity provider reserves the right to prevent or stop participation in an activity where there are reasonable safety concerns.
10. Assumption of Risk
Participants acknowledge that physical exercise, hiking, swimming, excursions and other retreat activities carry inherent risks, including the possibility of accident or injury.
Participants agree to follow reasonable safety instructions provided by the Organiser, instructors, guides, accommodation providers and other activity providers.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot legally be excluded or limited.
11. Alcohol & Personal Responsibility
Where alcohol is available during a retreat, participants are responsible for drinking responsibly.
The Organiser may refuse participation in an activity where a participant appears intoxicated or otherwise unable to participate safely.
Illegal drugs, threatening behaviour, harassment, violence or behaviour which places another participant, member of staff or third party at risk will not be tolerated.
12. Behaviour
We want our retreats to provide a welcoming, respectful and enjoyable environment.
Participants are expected to behave respectfully towards other guests, staff, instructors, local communities and accommodation providers.
The Organiser reserves the right to require a participant to leave the retreat in cases of serious misconduct, abusive or threatening behaviour, deliberate damage, repeated disregard of safety instructions or behaviour which materially disrupts the retreat.
Where a participant is required to leave because of their own serious misconduct, the Organiser will not be responsible for their onward travel or accommodation costs, subject always to applicable law.
13. Accommodation
Participants must respect the accommodation and comply with reasonable house rules communicated by the Organiser or accommodation provider.
Participants may be responsible for the cost of damage caused deliberately or negligently by them during their stay.
Room arrangements and occupancy will be specified for each retreat.
Where shared accommodation is booked, participants acknowledge that they may share facilities or rooms as described in the retreat information.
14. Food, Allergies & Dietary Requirements
Participants must notify the Organiser of allergies, intolerances or important dietary requirements before the retreat.
We will make reasonable efforts to accommodate dietary requirements but cannot guarantee that an environment will be completely free from allergens, particularly where food is prepared by third-party restaurants, caterers or accommodation providers.
Participants with severe allergies remain responsible for taking appropriate precautions and carrying any medication they may require.
15. Excursions & Third-Party Providers
Some retreat activities may be delivered by independent providers such as restaurants, guides, transport providers, wellness facilities or activity operators.
Participants must comply with the reasonable rules and safety requirements of those providers.
Nothing in this section removes any responsibility of the Organiser that applies under consumer or package-travel legislation.
16. Personal Belongings
Participants are responsible for their own belongings during the retreat.
We recommend keeping valuables secure and ensuring personal possessions are adequately covered by travel insurance.
The Organiser is not responsible for loss, theft or damage to personal belongings except where caused by the Organiser's negligence or where liability otherwise arises by law.
17. Weather & Outdoor Activities
Some retreat activities are weather dependent.
Activities may be changed, postponed, relocated or cancelled where weather or environmental conditions make the planned activity unsafe or impractical.
Where possible, the Organiser will provide a reasonable alternative activity.
18. Photography & Social Media
Photographs and videos may be taken during retreats for memories, social media and promotional purposes.
Participants will be given an opportunity to tell the Organiser if they do not wish to appear in identifiable promotional photographs or video.
We ask participants to respect the privacy of other guests when taking and sharing photographs.
19. Personal Data
Personal information collected during the booking process will be used for administering the retreat, communicating with participants, managing safety and dietary requirements and fulfilling our contractual and legal obligations.
Sensitive information, including health or dietary information, will only be used where reasonably necessary for the safe organisation and delivery of the retreat and handled in accordance with applicable data-protection law.
20. Unavoidable & Extraordinary Circumstances
Circumstances outside the reasonable control of the Organiser may include severe weather, natural disasters, wildfire, epidemic or pandemic restrictions, government action, civil unrest, strikes, transport disruption or other events which could not reasonably have been avoided.
Where such circumstances affect the retreat, the Organiser will act reasonably and in accordance with applicable consumer and travel law.
Nothing in this section removes any statutory refund, cancellation or assistance rights available to participants.
21. Programme Results
Retreat activities, fitness sessions, workshops and wellness information are intended for general educational and recreational purposes.
Individual results cannot be guaranteed.
Any nutrition, fitness, skincare or wellness information provided during a retreat does not replace individual medical diagnosis or treatment.
Participants should seek advice from an appropriately qualified healthcare professional where necessary.
22. Complaints & Problems During the Retreat
If a participant experiences a problem with any part of the retreat, they should inform the Organiser as soon as reasonably possible so that we have an opportunity to resolve it.
Where a complaint cannot be resolved during the retreat, it should be submitted in writing after the retreat with sufficient information for us to investigate.
23. Applicable Law & Statutory Rights
These Terms & Conditions do not affect any statutory rights which cannot legally be excluded or restricted.
Where a retreat constitutes a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018, the participant will retain all rights provided by those Regulations regardless of anything stated in these Terms & Conditions.
The governing law and jurisdiction applicable to the booking will be determined in accordance with applicable UK consumer law and any mandatory rights available to the participant.
24. Agreement
By paying the booking deposit, the participant confirms that:
they have read and understood these Terms & Conditions;
they agree to be bound by them;
they understand the payment and cancellation arrangements;
they understand that participation in physical activities is voluntary and carries inherent risks;
they agree to disclose relevant information which may affect safe participation; and
they will obtain adequate travel insurance for the retreat.
Payment of the deposit constitutes acceptance of these Terms & Conditions.
